Thailand SMART Visa 2026: Startup Founder's Complete Guide

Thailand’s SMART Visa programme was significantly restructured by Cabinet decision in January 2025, with new Board of Investment (BOI) rules taking effect in February 2025. Before the reform, the programme offered multiple categories — Talent, Investor, Executive, Startup, and Dependants. After the reform, only SMART-S for startup entrepreneurs and SMART-O for their dependants remain. If you are a foreign startup founder running a company in Thailand’s targeted technology sectors, the SMART-S visa gives you a two-year stay, work rights in your own business, and a path to renewal — without a separate work permit. This guide explains who qualifies, what the process involves, and how to plan your application.

What the 2025 Reform Changed

The Thai Cabinet approved the SMART Visa restructure on 13 January 2025 and the BOI issued implementing rules on 18 February 2025. The changes were significant:

• Discontinued categories: SMART-T (Talent), SMART-I (Investor), and SMART-E (Executive) were removed from the programme entirely.
• Former applicants redirected: skilled professionals, investors, and senior executives are now directed to the Long-Term Resident (LTR) Visa instead, which has Highly-Skilled Professional and Wealthy Investor sub-categories designed for this group.
• What remains: only SMART-S for certified startup founders and SMART-O for their spouse and children.

The BOI’s stated rationale was to remove overlap with the LTR Visa, launched in 2022, which already covers high-skill and high-net-worth foreign residents. The SMART Visa now has a tighter, startup-specific focus.

If you previously qualified under SMART-T, SMART-I, or SMART-E, those routes are no longer open. The LTR Visa should be your starting point instead.

Who Qualifies for SMART-S in 2026

The SMART-S is not a general entrepreneur visa. It has specific conditions designed for genuine early-stage startup activity in government-defined priority sectors. As of 2026, the eligibility requirements are:

Your company must:

• Be registered in Thailand as a legal entity
• Have been operating for no more than two years at the time of application
• Be certified as operating in a targeted S-curve industry by either the National Innovation Agency (NIA) or the Digital Economy Promotion Agency (DEPA)

Thailand’s S-curve targeted industries include digital technology, automation and robotics, smart electronics, medical devices, biotechnology and agriculture, creative industries, food innovation, and several others. Both NIA and DEPA publish their own certification criteria and application processes; the relevant agency depends on your industry sector.

You personally must:

• Hold at least 25% of the company’s registered capital, or hold a director position in the certified company
• Maintain a bank deposit of at least 600,000 THB (or the equivalent in your home currency), held continuously for a minimum of three months — this can be in a Thai bank or a bank in your home country
• If bringing a spouse or children, have an additional 180,000 THB per accompanying family member on top of the base amount
• Hold health insurance covering your entire period of stay in Thailand

The two-year company age limit is a firm boundary. If your startup has been operating for more than two years at the time you apply, it falls outside SMART-S eligibility. For more established businesses, a Non-B visa with work permit or the LTR Visa’s Highly-Skilled Professional category may be more appropriate.

What You Get: SMART-S Benefits

If you meet the criteria, the SMART-S Visa offers meaningful advantages over a standard business visa:

• Two-year stay permission: valid for two years from issue, renewable if you continue to meet the criteria
• No work permit required: you are legally permitted to work within the BOI/NIA/DEPA-certified business without a separate work permit — a significant reduction in administrative burden for founders
• Multiple entry: international travel during the visa period does not invalidate your status
• Spouse work rights: under SMART-O, your accompanying spouse is also permitted to work in Thailand without a work permit (see below)
• BOI support access: SMART Visa holders can use the BOI One Stop Service Center in Bangkok for faster processing of certain government applications

One benefit that is not waived: the 90-day reporting requirement. Like all long-stay visa holders in Thailand, SMART-S holders must report their address to Thai immigration every 90 days. This can be done online through the Thai Immigration online reporting system, by post to your local immigration office, or in person. Missing the deadline incurs a 2,000 THB fine per occurrence.

SMART-O: Bringing Your Family

If you hold a SMART-S visa, your spouse and children can join you in Thailand under the SMART-O dependent category. SMART-O provides:

• Same duration as the primary holder: stay permission matching your two-year SMART-S period, renewed alongside it
• Work rights for your spouse: unlike most dependent visa categories in Thailand, SMART-O specifically grants your spouse the right to work in Thailand without a separate work permit — a practical advantage for dual-income households
• No separate BOI certification: the SMART-O application runs through the same BOI process as the primary holder’s application

The additional financial requirement (180,000 THB per person) and health insurance for each family member apply for SMART-O applicants.

How to Apply: The BOI Process

The SMART Visa does not follow the standard embassy visa route. The process runs through the BOI and involves several sequential steps:

1. Certify your startup: approach NIA (for general technology and innovation startups) or DEPA (for digital and software businesses) with your company documentation. Certification requires demonstrating that your company operates in a targeted S-curve industry and falls within the early-stage threshold. Allow several weeks for this stage.
2. Apply for SMART-S endorsement through the BOI: once certified, submit your SMART-S endorsement application via the BOI’s SMART Visa online platform. The BOI reviews your ownership stake, financial evidence, and health insurance. Processing typically takes additional weeks.
3. Receive your BOI endorsement letter: if approved, the BOI issues a letter endorsing your application.
4. Obtain the visa stamp: take the endorsement letter to a Thai embassy or consulate in your home country. If you are already in Thailand on another valid status, you may be able to process the visa stamp at the BOI One Stop Service Center in Bangkok without leaving the country.
5. Register your address (TM30): once you have accommodation in Thailand, ensure your address is registered with immigration via the TM30 system. Your landlord is legally responsible for this, but it is worth confirming it has been done.

Total timeline: from starting NIA/DEPA certification to holding a SMART-S visa stamp, expect a realistic lead time of two to three months. Do not begin this process when your current visa is about to expire.
